Terms of Service

By accessing or using the ACCE Investments platform at acceinvestments.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

ACCE Investments is operated as a sole proprietorship based in the European Union ("we", "us", "our", or "ACCE"). These Terms constitute a legally binding agreement between you and ACCE.

ACCE Investments provides an online investment research and information platform that includes: AI-constructed thematic stock indices with daily NAV tracking; weekly investment pick publications; an advanced stock screening tool; financial scoring and analysis; portfolio tracking functionality; and related content including blog posts and market analysis.

The Service is an information and research product only. ACCE does not execute trades, hold client funds, manage portfolios on behalf of users, or provide personalised investment advice. Users execute all trades through their own brokerage accounts independently.

ACCE Investments is not a licensed investment firm, broker, financial adviser, or asset manager. The Service does not constitute investment advice, financial advice, trading advice, or any other form of professional advice within the meaning of Directive 2014/65/EU (MiFID II) or any national implementation thereof.

All content, including index compositions, weekly picks, stock scores, financial models, fair value estimates, and AI-generated analysis, is provided for general informational and educational purposes only. Nothing on this platform constitutes a personal recommendation or a solicitation to buy, sell, or hold any financial instrument. All information is addressed to the public generally and is not tailored to the specific investment objectives, financial situation, or needs of any individual user.

Past performance of any index, pick, or strategy is not indicative of future results. Investing in financial markets involves risk, including the potential loss of your entire investment. You should consult a qualified, licensed financial adviser before making any investment decision.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age in your jurisdiction and have the legal capacity to enter into these Terms. The Service is not directed at residents of jurisdictions where its use would violate applicable law or regulation.

To access certain features, you must create an account. You agree to provide accurate, current, and complete registration information; maintain the security and confidentiality of your login credentials; promptly notify us of any unauthorised use of your account; and accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or harmful purposes.

ACCE offers free and paid subscription tiers. Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you agree to pay all applicable fees at the rates displayed at the time of purchase.

Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time within a paid period.

We reserve the right to change subscription pricing with at least 30 days' notice. Price changes will apply at your next renewal. If you do not agree with a price change, you may cancel before it takes effect.

Under EU consumer protection law (Directive 2011/83/EU), you have the right to withdraw from a distance contract within 14 days of purchase without giving any reason. To exercise this right, contact us at legal@acceinvestments.com with a clear statement of your decision to withdraw. Upon valid withdrawal, we will reimburse all payments received from you within 14 days.

By accessing gated subscription content immediately upon purchase, you acknowledge and consent that the digital content delivery has begun and that you waive the right of withdrawal to the extent permitted by Article 16(m) of Directive 2011/83/EU once the content has been fully provided.

You agree not to: redistribute, resell, or republish any content from the Service without prior written consent; use the Service to provide investment advisory services to third parties; use automated tools, bots, or scrapers to access or extract data from the Service; attempt to circumvent any access controls, tier gating, or security measures; interfere with the operation or integrity of the Service; use the Service for any unlawful purpose; or impersonate any person or entity in your use of the Service.

All content on the Service, including but not limited to text, data, indices, scores, analysis, financial models, code, design, and trademarks, is the property of ACCE Investments or its licensors and is protected by applicable intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial investment research purposes. This licence does not include the right to copy, distribute, modify, or create derivative works from any content.

ACCE's proprietary scoring methodology, index construction methodology, and AI automation systems are trade secrets. No part of these methodologies may be reverse-engineered, decompiled, or reconstructed.

Portions of the Service, including stock analysis, weekly picks, alerts, blog posts, and index reviews, are generated or assisted by artificial intelligence (Anthropic's Claude API). While we strive for accuracy and quality, AI-generated content may contain errors, omissions, or outdated information.

AI-generated content is subject to editorial review but is provided "as is" without warranty of completeness, accuracy, or suitability for any purpose. You should independently verify any information before relying on it for investment decisions.

Market data, stock prices, fundamental data, and other financial information displayed on the Service is sourced from third-party providers including Yahoo Finance and may be subject to delay, inaccuracy, or interruption. ACCE does not guarantee the accuracy, completeness, or timeliness of any data and shall not be liable for any losses resulting from data errors.

Index NAV values and performance figures are computed internally by ACCE based on end-of-day prices and may differ from real-time market values. These are for informational purposes only and should not be relied upon as exact values.

The portfolio tracking feature allows you to manually input your holdings for informational and tracking purposes. ACCE does not have access to your brokerage accounts and does not verify the accuracy of information you enter. Portfolio values, returns, and analytics displayed are estimates based on the data you provide and available market data, and may not reflect your actual portfolio performance.

To the maximum extent permitted by applicable law, ACCE Investments, its owner, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages; any loss of profits, revenue, data, or investment returns; or any damages arising from your use of or inability to use the Service, reliance on any content or analysis, investment decisions made based on information from the Service, or interruption or errors in the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to ACCE in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable EU law.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, ACCE disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components; that any content will be accurate, reliable, or current; or that the Service will meet your specific requirements or expectations.

You agree to indemnify, defend, and hold harmless ACCE Investments and its owner from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of a third party.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes constitutes acceptance.

Either party may terminate these Terms at any time. You may terminate by closing your account and ceasing use of the Service. We may terminate or suspend your access immediately, without prior notice, for any reason including breach of these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall survive.

These Terms are governed by and construed in accordance with the laws of Spain and applicable EU law. If you are an EU consumer, you benefit from mandatory consumer protection provisions of the law of your country of residence that cannot be derogated from by contract.

Any disputes arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Madrid, Spain, without prejudice to your right as an EU consumer to bring proceedings in the courts of your country of residence.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
